The Supreme Court on Tuesday rejected Republicans’ latest attempt to overturn Pennsylvania’s certification of President-elect Joe Biden’s victory on the electoral battlefield.
The court without comment declined to question the certification process in Pennsylvania. Democratic Governor Tom Wolf has already certified Biden’s victory over President Donald Trump, and the state’s 20 voters are due to meet on December 14 to vote for Biden.
Either way, Biden won 306 electoral votes, so even if Pennsylvania’s results were in doubt, he would still have more than the 270 electoral votes needed to become president.
The court’s decision not to intervene came in a lawsuit led by US Republican Mike Kelly of northeastern Pennsylvania and GOP congressional candidate and Trump frontman Sean Parnell, which lost to US Rep. Pittsburgh area Conor Lamb, a Democrat.
“Even those named by Trump and the Republicans saw this for what it was: a masquerade,” Lamb said on Twitter.
In court records, Pennsylvania attorneys and Governor Tom Wolf, a Democrat, called the trial allegations “fundamentally frivolous” and his claim “the most dramatic and disruptive invocation of the judiciary in history. of the Republic”.
“No court has ever issued an order quashing a governor’s certification of presidential election results,” they wrote.
Republican US Senator Ted Cruz of Texas had offered to plead the case if the high court took him.
Having lost the court’s request for immediate intervention, Greg Teufel, an attorney for Kelly and Parnell, said he would file a separate request to ask the court to review the merits on an expedited basis.
Still, hopes for an immediate intervention in the Nov. 3 election “dimmed considerably” with the court’s action on Tuesday, Teufel said.
“But it’s by no means over,” Kelly told Fox News.
Republicans had pleaded with judges to intervene immediately after the state’s Supreme Court dismissed their case last week.
Republicans argued that Pennsylvania’s extensive mail-in ballot law was unconstitutional because it required a constitutional amendment to authorize its provisions. Only one Republican state legislator voted against its passage last year by the Pennsylvania Republican-controlled legislature.
Biden defeated Trump by more than 80,000 votes in Pennsylvania, a state Trump won in 2016. Most of the mail-in ballots were submitted by Democrats.
The state’s high court said plaintiffs had waited too long to file the challenge and noted Republicans’ staggering demand that an entire election be overturned.
In the underlying lawsuit, Kelly, Parnell and the other Republican plaintiffs had sought to either reject the 2.5 million mail-in ballots submitted under the law or to erase the election results and order the The state’s Republican-controlled legislature selects Pennsylvania’s presidential voters. .
